say you owe the debt and your husband wants his money then he is the injured spouse b/c he isn't responsible for you,,,, if you only have no kids or one you might think about not filing with you at all... the payment might be a little smaller but if you have three kids like me and my hubby then its better to do it the long way, we stand to get back 5110 but if he would of filed alone then the payment would of only been 750....errr... we filed on jan. 29 and still haven't got it so its a long wait

The "injured spouse" is the spouse who is not personally liable for the debt. If you have outstanding loans, your husband would be the "injured spouse."

my new sister in law went thru that last year. My brothers ex wife had some debt still owed from when they were married and they took my new sister in laws tax money that was due to her. Well she filed an amended return as an injured spouse and got her money back. My brother still had to pay because it was when he was married to my ex sister in law.
