Some *** ran into my car a month ago. When the police got there they issued no tickets. (Something about parking lots being private property and not being able to issue tickets on private property.) The guy had liability insurance. So, I called in to his insurance company to get my car fixed and they said there was a problem with his insurance. I got a message on the machine a week later telling me that he isnt covered and now my car is all banged up.
I live in Montana, and it is illegal to drive without insurance. I have insurance but my insurance company only covers up to $500 of damages. Plus, I am young and dont know what filing that will do to my insurance costs. (Because once I was rearended, totally not my fault, stated by the police and everything and my insurance still went up.) I am just a poor college student.
Do I just have to suck it up and realize I got screwed. Or, is there a way to get my car fixed.

OF COURSE there is a way. CALL YOUR INSURANCE COMPANY. Even if they don't do "comprehensive" they want to keep you as a customer and thus they will HELP YOU by making the other guy pay up. Explain the situation to them and ask for their advice. Also notify the police that the other guy has insurance cancelled. Also check if your insurance covers "uninsured drivers". Again, you should always ask. They can always say no, but if you don't ask, it WILL BE A NO!

I've never heard of an insurance company that will only pay $500. Are you sure this isn't your deductable. Call your company again - If you have collision coverage, it will be covered. If not, you need to pursue the other driver directly. If your damages are below a few thousand (the actual amount varies by state), you can sue in small claims court which is cheap and easy and you don't need a lawyer.

The other insurance company is required to advise you of the denial IN WRITING, so make sure you get that ASAP. If they do not advise you in writing, then keep pursuing them to pay for your car.

Where are you getting $500 from? If this is your detuctible - this is the amount YOU pay before the insurance company takes over. If you're car has more damages than $500, then your insurance will pay for it.

If you just have liability, then you can take the driver to court and sue for damages.

Call your insurance company, see what they say.

If you have to pay a deductible, I think you can sue the other driver for that amount.
