my husband died, can my 3 children draw off their stepfather social security?

Sorry for the loss of your husband. No has to be their legal father. The legal father is responsible for them. Unless they were adopted, You cant get child support and SS for the kids off the other "dad" If the other isnt paying you will have to go after him to step up.

Unless he legally adopted them, I dont think so. But, it doesnt hurt to call the Social Security office to find out. They should be able to help you. I am sorry for your loss.
