I need to know if a person is living with 2 children and their parent, but is not related to any or married to the parent, and he is the only income, can he claim the 2 children and the parent on his income tax as being his dependents?

No. go to www.irs.gov, individuals, what is a dependent?
Please don't listen to bad advice on this one. If someone claims children that they are not allowed to and refunds are given. If it comes back it can be more than money(fines, penalties, etc.), food stamps, rental asst., etc can be taken away for tax fraud.

If they all lived together ALL year, and the parent of the two children had under $3300 in gross income, and the other person provided more that half of the support of the parent of the children, that person can probably claim the children's parent as a dependent, but will NOT be able to claim the children as dependents, and can't file as head of household for having the parent of the children as a dependent since they're not related.

So far 2 answers that don't understand the rules. Your question does not give enough information to be sure, but they MAY be considered 'Qualifying Relatives' even if they are not related. Page 20 of the 1040 instructions lists the rules for Qualifying Relatives.

The rule changed back in 2005.

As of now, as the kids are the other persons qualifying dependents, he can not claim them even if he supports them.

He "may" be able to claim the adult but it depends on multiple factors.

Yes he can. If they lived with him all year, each of them earned less than $3,300, and he provided more than half of their support, he certainly can claim them on his return.
