Both wills were signed and dated only 1 day apart. Does anyone know the law in NJ on this subject?

Don't know the specific NJ law, but as a general rule...whichever will was signed and dated LAST is the one that is valid.

I would think the will that was written on the most recent date would be valid but check with your lawyer or the person who wrote the wills lawyer just to be on the safe side.

I would suspect the most recent one makes the first one void. The exceptions would be if the person was forced to sign it or was not in his or her right mind at the time. However, check with a local attorney.

I'm not from NJ - however it's always the most recent Will that's valid.

The one with the most recent date, if filed correctly. It should've started out with wording to the affect "This supercedes and voids all others previously...." yada, yada.

Last will signed is the winner. Of course...anything can be contested in Probate so don't consider it a "done deal" just yet.

The later date prevails. If one will is notarized or witnessed, then it could take precedence, but if they both are, the later date always prevails.
