Who has custody of a child if a couple is unmarried & seperates ?

That depends on where you live. No one actually has custody until it is ordered by a judge.

It actually is a little different from state to state. But from my own experiences I'll tell you what I know. If the father signed the birth certificate then they both have custody rights. But all you have to do is go to the court house and ask for immediate TEMPORARY custody. Then they'll (most likely) grant it to you and then set a court date for permanent custody. After that it's up to the judge. But if you're worried about the child being taken away by the other parent, then I'd definately get temporary custody and let them know that when you go file for it. Otherwise, the other parent can take the child and go wherever they please. Good luck.


PLEASE, PLEASE, PLEASE don't listen to all of those people who tell you that the mother automatically has custody. That was true many many years ago... but now judges are giving custody to more and more men, due to women's liberation. It is being said that if women should be equal in the workplace, then men should be equal in the child rearing. (as they should). But NO ONE automatically has custody. It must be awarded by the courts... I wouldn't lie to you about something so important.

usually the mom, but sometimes the dad is rewared custody if mom is not fit or doesn't have a job her own place to live things like that. the best way to figure things like custody is through the courts let a judge decide where the child/s should stay

If you think he's at all abusive, get your son and get far away. Get a lawyer, get custody, and leave. Once he's with you, that's a guarentee. Based on his history, I wouldn't trust him with your kid. Just because you have a paper that says you have custody won't stop him from pulling this off again.

whoever gets to the court and files for the child first will have temporary custody until a judge hears your case.

the mother if the faher wasnt ever married to the you. if you both were married when the child was born then you would have to go to court over it.
