I bought a box of pop tarts at a local Walmart two days ago and this morning I opened the box to give my daughter one and there were ants all in the package. (the sealed package) some were alive and some were dead. I called kellogs and all they said was that they would send me some coupons. I dont want coupons i want something done about this! I dont see how a company can sell a food product with ants in them!

Ok my question is should i get legal advice from a lawyer? Or just let it go.
Please Help!

Well chances are that they came from walmart. And even though its really gross, nothing would have happend to your daughter had she eaten the ants. There are people that eat them as a delicacy. I would however recommend that you return the package of ant ridden pop tarts back to the store and get your money back and I think shopping there should probably just be limited to other household items and the occasional cute outfit.

I am pretty sure that an attorney would prolly suggest you do the same although there are plenty of Lawyers that engage in frivolous lawsuits.


Just remember that he/she has prollly eaten a few grosser bugs then ants when you weren't watching.

The cost of getting legal advise will probably be more than what the end result is worth. All Kellog will do is try to put it on wal-mart. And wal-mart will blame kellog. You're talking about a three dollar box of pop tarts. Getting legal help isn't free, and what are you expecting to gain out of this? I would say just try to get as much free stuff from them as possible and then let it go.

I think you should except the coupons as maybe they did come from Walmart and when it's to warm and sugar the ant will be coming for all that sugar. I would of took my box back and got a whole new pop tarts box and a different Walmar location if I could. Also don't forget to clean out you pantry.

The problem is that you can't really prove your argument unless there are ants in the other sealed package, and how would you know unless you unseal them? You might want to just let it go. Make sure you are compensated for the box you purchased and leave it at that. Legal action can be expensive and since no harm was done, there may be nothinig to gain from it.

I don't think you should Walmart probably was where they were picked up and if your daughter ate one it would be gross but not harm her some people eat them and they have protein (yuck) If you do sue though remember a lawyer for a long case is about $15,000 and poptarts are $2-4

2 days after you bought them and you blame Kellogg's?? I agree the ants either got there in transit or after you put them in the cupboard. I get ants all the time. You're lucky they weren't roaches. I don't mean you're a bad housekeeper, but this is Florida, where more bugs live year round than anywhere else. next time, put them in the refrigerator.

They probably came from Walmart. They'll let the pallets of non perishable food sit on the dock. I doubt they came from Kellog. Or, have you checked your pantry?

Sue the pants off of them, why should you be the only one not to profit from the negligence of a big conglomerate. Their insurance will pay it anyway, it won't hurt them a bit! Whatever you do, don't let it go, this is the kind of negligence that people die from!

As for me, I would just let it go. Something happened, and it was probably a mistake. But it could be a serious issue, that you should get some legal attention.
