Correct, generally when you are legally married you have 2 choices Married Filing Joint or Married Filing Separate.
You may be able to claim the Head of Household filing status IF you lived apart from your spouse for at least the last 6 months of 2006 AND have a dependent that you provide more than 50% of their support.

Yes, if you were married as of midnight the night of 12/31/06, you need to file as married, either a joint return if you can agree, or as married filing separately.
The only exception would be if you didn't live together anytime during the second half of the year, and one or both of you had a qualifying child living with you for more than half of the year and that parent provided more than half the cost ofkeeping up the home for the tax year, then that parent could in most circumstances file as head of household.

If you were married on December 31, 2006 - then you have to file Married (joint or separate, your choice...which will obviously depend on how you and ex get along)
If you were divorced on December 31, 2006, even if you were married all the other 364 days...you file as Single.

I believe you're right. Since taxes were taken out WHILE you were married, that's how the government sees you. Might be smart to ask a tax accountant (the cost is well worth it - given the peace of mind you'll get)

My husband got divorced from his ex in October...he was required to file as single, even though he had claimed married tax status all year.
He got royally screwed because they take so much less money from married than they do single.

See a good tax accountant, they will be able to help and save you money. Do not go to one that only dose it doing tax time.
