MPRI considers its overseas employees as private contractors for tax purposes but the IRS says they are definately employees and MPRI must with hold taxes. Rumor is the IRS has a pending law suit against MPRI.

If there is a lawsuit, you might be able to search on Westlaw or Lexis. They charge several dollars a minute to nonsubscribers. Alternatively, if you work for MPRI, you might want to file a form SS-8 and have the IRS tell you whether you are an independent contractor or employee. Tough for you employer to tell you differently if they have already ruled.
