And the courts of that State (PA) will do nothing to assist the father. The Ex wife in question is even having the children call her BF Daddy.
It is agains written laws in the state of PA for this to happen, but the courts repeatedly rule in her favor, tell her "Bad Girl, here's the slap on your hand".

So, My question to you , is this...Seeing as how she is refusing his rights, and the courts are not helping him (AT ALL!)

Do You think He should have to Pay Child Support?

There is already an exsisting court order, yes. And The Ex is having the kids call her new Boyfriend Daddy, if he sends them presents, she says they're from her. He can do nothing in this situation except try to rebel, and frankly, as his wife, I support him in this decision. I was really hoping for an answer from someone who had went through this. Or is a lawyer and knows about this.

Also, the extreme amount the court in PA is demanding is causing a hardship on the support of our child. And the state refuses to drop the amount.

Don't worry. The children will take it out on the mother when they get older. Children figure stuff out and in cases like that the mother always regrets doing what she did and many times the kid(s) never forgive her.

No, you can not refuse to pay child support. Visitation and child support are not tied together. The courts get a lot more upset at lack of child support payments than they do over visitation issues.

What he CAN do however, specially if the boy friend is living with her, is to get rock solid proof they are living together, then go to the court and sue for custody because she is not providing a proper home for the child. He may have to settle for joint custody, which means he gets the kid half the time.

That solves the visitation issue AND the child support issue as he will not have to pay it since he takes care of the kid HALF the time.

Yes. He should still have to pay his child support. Child support is to aid in expenses occurred by the custodial parent. Child support doesn't pay for visitation.

If you're husband/bf wants his visitation rights honored, he should get an attorney and make the courts set a visitation schedule. If the ex decides to disregard the courts order, she can be held in contempt of court.

Good Luck.

First understand that very little about our system is correct. Child support is a joke in the first place and visitation should never be denied to a trustworthy parent. You legal solution is to take her to court and arrange a visitation schedule.

Yes he should continue to pay because if he doesn't he can go to prison. He needs to get a better lawyer.
