I have new neighbors upstairs in an apartment....the lease says no loud noise after 10pm. They are constantly noisy...music, loud sex, etc. It keeps my 10 year old son and myselfn up most of the night. My landlord has sent them notices...they dont seem to care and I have already talked with them in person. What is my next step so I can get some shut eye?

As mentioned -- call the police, or (depending on where you live) the by-law enforcement officers.

And the people responsible for making your landlord do his job. Whoever administers landlord-tenant regulations in your area can give you more information. Talk to him a little more first, though -- he may be gearing up to evict them. As mentioned, again, it will eventually be worth it to him to shut you up, so to speak.

Keep records of (1) their noise, and (2) your complaints to the landlord, and police.

Ask the landlord to be a little more useful than giving notices; when it's loud, call him, and ask him to call them. Then, not the next day.

In the meantime, would a white noise machine be of any use? Even a loud fan can be a help with that sort of thing.

The problem can only be solved 2 ways. They go or you go. Do not beat around the bush when it concerns your family. Start by searching for a new place to live, I'm not saying run away but do have a look around. Then you complain to the landlord as many times a day as is necessary. Do phone the Police whenever you have to and make sure you give them the landlords apt. # so they can do their job properly. Lastly find out who actually owns the apartment complex you are in (ask the landlord) and start reporting every incident. Make sure you keep some sort of record of who you talk to (date, time etc.) so you have some sort of reference if you ever have to take legal action. Things will sort themselves out fairly quickly and you will be better off for it.

Call the police and file a disturbing the peace complaint. THEY will talk to the neighbors. And also since they are violating the lease those landlords are supposed to do an eviction, period!! You have rights under that lease and you can sue them if they do not enforce it.

Depending on how long you've lived there if you have been a good paying tenant, keep complaining to the landlord until he acts. Sounds like they should be evicted for breaking the terms of the lease.

the way it sounds they are night people and you have a son so id say get even the best way possible be as loud as you possibly can during the day while the are trying to sleep. blast your tv and music and and tell your son to scream as loud as he can lol. oooh make a play date and buy some ear plugs and get all the kids to scream as loud as they can then after about an hour or two of screaming they will shut the hell up i bet

Pillow case party. get a pillow case and a bar of soap,and a couple of buddies, get your buddies some beers, next time the noise starts, knock on the door swinging the pillow case with the bar of soap in it, and keep swinging till the noise stops.

keep reporting them and get a witness to the noise soon the landlord will just boot them out , he'll get tired of hearing you complain

geezzz, im so sorry you and your kid have to put w/such BBB.
perhaps you should consider moving, calling the landlord, his,her boss, the city, cops. depends on your lease/rental agreement. sounds like you should consider country, if you can, it's so worth it!

i have the same problem. I call cops when I am sure it is loud enough and know it will last a while. I call cops as often as possible but I try not to disturb cops. But thankfuly, my local popos are so kind and helpful.
Unfortunately, my neighbor is still loud at late night so i now try to make loud normal living noise as much as possible during the day to disturb their sleep during the day. I wrote a letter to my landlord but it didn't help. so i guess i need to write again. But the annoying thing is that this situation is not that easy as we think to solve. In my state, i looked up tenant law but it sucks. in order to get out of lease, i have to hire a lawyer and proove the noise is more than normal living otherwise the landlord lets me get out of it without all hose hustle......
