my daughter has told us that her father has molested her, during his overnight visits. when she told this to us, we called the police right away. the sheriff actually came and questioned my daughter. next, she went to question him. he would not speak. due to his violent behaviors, we were issued a restraining order. anyway, we had court today. it was to be our first court hearing concerning my daughter's molestation. his lawyer showed up, but he didn't. what are some reasons he may not have come? could he have gotten arrested if he came?
also, i have applied for another restraining order. mine was only temporary and ended today at 5pm. i am very afraid of what he will do to my daughter, who is 3, now that she has told on him. how hard is it to get a restraining order against a person who has two felonies, has threatened to beat me, and who has a daughter who says he has been doing disgusting things to her? thank you all for your time.

the restraining order expired today. this is why i'm worried. all that was discussed today was a time for another hearing! i'm upset about that. it was actually an ex-parte thing and my lawyer was supposed to ask that the father's visitation stop until the investigation is over

i actually have a victims advocate! if the DA believes my daughter, and this becomes a criminal case, i'm gone!! this guy is very violent

It depends on what type of hearing it was today. IF it was criminal case, a warrant would have been issued for his failure to appear. It sounds like it was to for the protective order? These hearings are not criminal and it is possible he appearance by counsel (his lawyer) was sufficient, but I doubt that. Usually the lawyer will have to explain to the judge why the defendant/client is not there. They can proceed ex-parte (without him) [ generally okay in restraining order cases] or, more likely, continue the case until he can make be present. IF it is a restraining order hearing the judge probably said something like the order is extended until the next hearing.

If you have more questions you should contact the prosecutor that was at court and find out more.

I am sorry about your daughter....it is not her fault nor your fault, it is his..(If he did it ofcoaurse)
No he wouldnt have gotten arrested today, unless he had a warrant out for his arrest....
If he had of shown up, they would figure out court dates etc...to have a trial etc..etc....
He probably didnt show up because he was ebarrassed he got caught....ormaybe he is trying to casually leave the scene,a nd not talk to you's anymore, but you never know...maybe he thinks this is totally ridiculous, and he could never do anythign like that to your daughterand he is just ignoring it. You said he is a violent person, which kinda is bad on his part. Maybe makes him seem more "guilty".
Go with your gut instinct, it is always right...tell him untill things are proven..you cant be near him, or aroud him....Just tell him it is very important because it's your daughter, and you never know...nobody expects their childs father to be a child molester,or else they would have never had a child with them, so let him know you are beign careful and cautious...untill everything is done.
Hopefully this all gets cleared up, and if he is guilty you and your daughter can put your pasts behind you'sand start over on a fresh new path..goodluck!

his lawyer showed up so he doesn't have to, i am sure the restrainign order was put into place so he shoudl not get visitation, however i would find a place to stay with family or another friend.
it doesn't matter if he has no felonies it is the same process, i do nto understand why you are worried about your daughter, and why you are aksing abotu a restrainign order..you said you went to court today, they shoudl have carried it over, did they drop the restrainign order you already filed?

First of all I'm sorry that happened to your daughter.....If I were you I would find somewhere to else to stay. Like a friends, your parents, etc. Don't let him know where you are. If he does come around call the police immediately.
