My husband and I have seperated but are still married, in the past years I was unable to claim EIC because he is not a citizen with a soc. #. But now that we are seperated am I able to claim EIC for our son, who lives with me and only sees his dad about two - three days a week, he never stays with him, just visits.

If you and your husband do not live together.... Have not lived together for the last six months of 2006 then you can file as Head of Household with your son as a qualifying dependent. Then it will depend on how much you earned. This all assumes you provide more than 50% of your child's support.

EIC phases out at about 32000 with one qualifying dependent.

If you are legally seperated (through courts) or seperated for atleast 6 months out of the year (that means every night away from each other for 6 months), or divorced, then you shouldn't have a problem. Look online under irs.gov maybe & it should have an earned income checklist you can use. Or call a local tax preparation office & they will be able to explain it all to you.
