I have been calling the corporate office for over a week, several times a day because no one ever picks up their phone. I have also contacted the store themselves and they have told me it is not thier problem. I have not worked for this company since July and lost my last paycheck in the move. Do I have any course of action at all?

(PS please do not chide me for loosing my paycheck, I feel bad enough.)

Maybe I should add that I do know W2s are supposed to be sent by January 31st. If it had been, i would not be asking this question.

If you still do not receive your W-2 by February 14th, contact the IRS for assistance at 800-829-1040. When you call, have the following information:

Employer's name, address, city, and state, including zip code.


Your name, address, city and state, including zip code, and Social Security number
If you misplaced your W-2, contact your employer. Your employer can replace the lost form with a “reissued statement.” Be aware that your employer is allowed to charge you a fee for providing you with a new W-2.

You still must file your tax return on time even if you do not receive your Form W-2. If you do not receive the missing information in time to file, you may file you may use Form 4852, Substitute for Form W-2, Wage and Tax Statement. Attach Form 4852 to the return, estimating income and withholding taxes as accurately as possible. There may be a delay in any refund due while the information is verified.

If you receive a Form W-2 or W-2C (corrected form) after you have filed your return using Form 4852, and the information differs from what you reported on your return, you must amend your return by filing a Form 1040X, Amended U.S. Individual Income Tax Return.

Keep calling the corporate payroll office. They are the only ones who can fix this problem. If you can't get through, call the IRS and file a missing W2 complaint. They will assist you in getting the missing W2 or help you in providing alternate documentation for your earnings and withholdings. If you go the alternate documentation route you need to wait until just before the filing deadline to file. The processing of your return will be delayed while the IRS attempts to verify the information.

You were supposed to receive the W2s by law by January 31st. Contact the IRS to see what they say.

Fed law dictates that it is supposed to be in the mail by the end of January. If the company won't respond to you, I'd suggest you contact your tax acct. if you have one do your taxes.
If you do your own taxes, contact the IRS and explain the situation to them. They will most likley come up with some idea.
And don't feel bad. I loose things all the time.
