I have not seen my ex in over 4 years and went to serve in Iraq since then. I have never filed for a divorce but signs point toward being divorced from her. I filed my taxes single and got some credit reports and have not heard anything about her from the IRS and she does not show on my credit reports. Is it safe to say she filed for the divorce unknown to me and that we are divorced?

I do not think I would be served papers if I were in Iraq fighting a war, do you?

Chances are youre not divorced. If she filed then you should have been served due process of law which means you should have been notified thru the proper chanels of such. True she could have gone thru other channels to do this but you should have notified of the outcome. Dont go by the credit reports as they should have only shown you as married and these reports are not current but nothing about hers. Id check with the dept of records where you two last resided just in case, to be sure before you get yourself into real legal trouble. Good luck and thank you for serving your country

You are not divorced till you sign the papers too. Check with the County Court office.

You should go to court and find out. Is there a county that you believe she would have filed in? Maybe one close to her family? I don't believe that you can get divorced without the other party consenting.

No, you need to take care of this pronto. I know of a couple where the man was in the military out of the country. The woman took out all sorts of credit and loans in his name. Took years and thousands upon thousands to clear up. Wise up before she does.

where would be the place court do you know? if its in big city go to court house and it would be filed there.

No, don't assume anything. Get ahold of an attorney who can look it up for you.
