The 10 years is the maximum. You may be asked to do community service and asked to make restitution. However because you recently gave birth you may not even get community service, read below.

It sounds from your question that the District Attorney and your Attorney have already struck a deal. But even when a deal is struck you still have to go to court, it is because in the Constitution. You have the right to confront your accusers and the State can not sentence anyone unless it is in a public forum. This is to protect people from being arrested by the state and putting them in jail without due process, like what used to happen when America was a British Colony and before the Constitution was written.

The King ot his representative at the time could arrest any person and put them in jail without filing any charges or having any public hearing. In effect it is to protect against the practices of a police state.

Everyone makes mistakes, especially if they become overwhelmed, the important thing is not to repeat them. Tell your Dad and Grandmother in the court you are sorry you did it and you are sorry that you hurt them.

You also mentioned you had a month old child. The law recognizes and has recognized for hundreds of years that mothers who have just have given birth sometimes lose control and do stupid things they would not usually do -- it is a legitimate mitigating circumstance under the law. But let your lawyer mention it, don't say it yourself.

Remember everyone makes mistakes, this is not the end of your life and it does not mean you will never find another job. A year from now your life will be like it never even happened.

God bless and take care and next time you feel overwhelmed ask for help.

ps, I read that you have already made restitution, once the restitution was accepted, it guarantees that you won't go to jail, the value of your theft has become $0.00 and is part of a plea bargain for forging the document. The judge may decide not to give you any punishment because you do have a legally recognized mitigating circumstance. But act contrite and do not do it again. If you do do it again you make a fool out of the judge and they don't like that. Next time ask for help from family, friends, the church, state programs, see a social worker, they will find a way to get you the help you need.

"...basically i was working for the bank and i signed his nam eto withdrawal slip."

When you go to court, if you tap-dance around what you did in this way, the judge is likely to be very harsh with you.

You didn't just sign your name to a withdrawal slip. You stole $456 dollars, $450, and $15, for a total of $921. You are a thief.

Own your actions. Admit that you are a thief, that you and you alone are responsible for the theft, and that what you did was wrong.

Admit that you need help and that you will take whatever help is available, including surrendering your children to CPS while you get your life straightened out, so you will no longer steal.

Then follow through. You are a mother and you have no right to put your kids in this circumstance. For their own good, you need to get your act together. Even if it's hard, you owe it to your kids to do what is necessary.

Own your actions and start to get your life straight. You've already given yourself a criminal record that will keep you from getting some kinds of jobs. Find a way to get straight before things get worse.

Good luck.

It is very unlikely you will go to jail. Chances are they will plead out, make you pay restitution and you will be on your way. Take a deep breathe. I know what you are going through. I was there a couple of weeks ago. If you are a good citizen with no priors they are not going to want to put in jail. They can, but they would require a trial and chances are they are too busy for that and will go with a plea. Trust your lawyer. I know it hard, but they are there to help. They can't promise an outcome. Stay out of trouble. A tough straight life is a much better one than the opposite. Good luck.

If they just want restitution...then PAY THEM!!! U better have the money up front when u get there.

If u don't and they send u to jail then they will put your kids in a foster home/orphanage if no family members with take the children

Good Luck hun.

Try your best to get probation and fines. If they wan't to lock you up (which they do send single mothers to jail) there's nothing stopping them from putting your kids in foster care if you don't have a family member to care for them. I hope your lawyer does a good job getting you off the hook.

Don't steal anymore!

Good luck
