i found out that the house my x-husband owns a home and several other things that his mother said my son has know rites to. see has moved into the house and also signed my son's fathers name on a title and stamped it to apply for a lost title months after the death she is a notary therefore she feels that she can get away with it but i'm not going to just sit back and watch her take away from my son. someone please tell me what i can do or what i have to do to get what belongs to my son.

I want to than everyone who responded so quickly. I have one more question what kind of attourney do I look for? I mean we I'm kinda a dumby with this but it's a good thing that means that my life is ok otherwise. thank you guys again very much

1.) Notaries are not allowed to notarize their own signatures. Moms could lose her notary license.
2.) Probate hasn't happened.
3.) Did your ex leave a will? If not, then this whole thing has to go to court and be probated. The judge makes a decision. Who gets what and how much depends on the state in which he resided.
4.) Hire the best attorney you can afford NOW. See if he or she will take your case on a percentage contingent fee.

by law, your son has the lawful right to everything, he is first in line; if no offspring then to his Mom ; there is such a thing as fraud and you can't sign and notarize your own signature; was an estate opened?? Did your ex have a will ? You really need to get a lawyer to safeguard your son's inheritance; also to get social security for your son?? you don't say how old he is ???

You need to contact a lawyer, and let him do your legal work for you, on behalf of your son. You need to get a death certificate. and you son, if a minor is entitled to him fathers social security.
