Is a Open Container violation a simple misdeameanor or just an adminstrative fine?

Depends on the state and who picks you up! In some cities it is a violation, if you are caught on the road by the state police it is a misdemeanor, at least in my state!

Depends on your state. For example here in TN it is not even against the law, you can have a open container.
