I called today to try to arrange payments, and they wouldn't let me do what I could afford ($50 dollars a month). They said that I had to do $100 or they wouldn't do it. Can they do this? He said that even if I sent in the money ($50 a month) they were going to garnish my wages and they would "continue collection efforts". Can they do this?

It is for an unpaid traffic ticket (obviously the court sold the debt to the collector). When I called today he wouldn't let me speak to a supervisor (I AM the supervisor) and said that he had to get a payment amount approved through his board of directors (he put me on hold for about 1 minute, so I know he didn't do anything of the sort.. who's board just sits around in the office all day?) and told me they said no...

By I Am the supervisor, I meant that is what he said to me. No I do not work for them!

There are things called "Abusive Debt Collectors". Contact the FTC and make a formal complaint. As far as them garnishing your wages, they have to go to court and give you a chance to go to court also. Send them in the $50.00 IN A MONEY ORDER, RETURN RECIEPT REQUESTED!!!!!! That way if they illegaly garnish your wages or you do get to go to court, you can have proof you was paying for the ticket. If they REFUSE to accept the payment you have proof you was trying to pay. Make sure to keep track of WHO you talk to, WHEN, and WHAT TIME. The web site i provided will REALLY help

Be careful, even if you pay $50/month they will take all that money, then go and sell your account to a different collection agency for the original amount you started with. For example, the collection agency was trying to get $1,200. They want you to pay a minimum of $100.00 to pay it off in a year. You can only afford $50.00, so you start sending in payments for let's say for 6 months. The collection agency will take the $300 you paid them for the past six months, sell the account to a different collection agency for the original amount ($1200). So now you have a new collection agency with the same amount of debt you started with, which $1200, they will not include the amount you have already started paying because you never met the minimum amount that they were asking for ($100).

Ok, here is what no one is telling you.. Since it is a court fine (traffic ticket) it already is public record and a judgment - no suit needs to be filed what so ever. They can simply submit it for garnishment that is why they are in a position to demand your payment in full and not accept payments. Don't let this get to your employer. But..if you have a good repoire with your employer see if you can take a draw out, explain the situation, pay it off, and have it deducted from your paycheck at $50 per month on your terms. It has been done and can be done.

go to www.lexingtonlaw.com and read the blog there from a collection lawyer. I was doing some reasearch just yesterday and I found that there are many things collection agencies can and can't do. You can call them on it if you can back your self up with facts. This site also offers credit mediation services which I am thinking about trying. It will save be a headache. What do you mean when you say you are the collection agency supervisor? Do you work for the company?

I think they're crying wolf. The legal process required to garnish someone's wages is lengthy and expensive. They would probably only do that if your traffic ticket is upwards of $5,000. Only then would it be worth the hassle for them. Collection agencies often lack the professional manpower to do that.
Since your ticket is probably less than five grand, I think they are just trying to scare you. Hold your ground. If it's already on your credit report, then the damage is done. If they want their money bad enough, they'll work with you.
I always advise my clients to hang up with the rep. if they're not getting anywhere. Call the next day and speak to someone different. You might have better luck.

have you gone to court and had a judgment placed against you? If not send them the 50 every month till paid off. If they go to court and you have proof you are paying then they may get thrown out by the judge since they do not come with clean hands you are making the effort to pay.

If it was a credit card company they were probably just doing that to scare you. It usually isnt worth it to them to try and get your wages garnished b/c their court costs would outweight the amount of money you owe. Unless you owe hundreds of thousands of dollars or something

No, don't be intimidated, they will take whatever you can give them. They are taught to bully people to get the maximum money from you.
