sounds like you have some real good role models there.
Probably all that would happen is that you would cause more
friction between your parents.
Try it........whats the worst that can happen?? They make you go back to your moms. You are almost 17 so in a year you can move out and not deal with her anymore

Well if you told the police that she had mood swings and what all she does to you and compare that to your dad then i don't think they can make you leave!!! I am sorry that your going through that but i am seperated from my mom and she was not doing the right thing for us kids and i am going to be 17 in May so as much as i love my mom i would rather be with dad but away form my aunt!!

The police are likely to get involved, because your mother will likely bring them into it. At that point, your parents' drug use will probably be brought out into the open. You won't be doing your dad a favor.
The way your father treats you will almost certainly change if you life with him all the time. Rather than bring your parents into court (which, by the way, will bring you and your private life into court) I would suggest talking to your mother and suggesting you BOTH get therapy. Don't try to break the law to fix it. Family law in particular is a mess.

Well legally I think until you actually turn 18 you could be told to go back to who ever has custody, but if your description of them is accurate you probable shouldn't worry about it too much! I'd say just stay with the pot head of your choice (the one with the best stash ;-) and just put off the other one until the birthday rolls around.

You are now old enough to make your own choice but you need to go through the courts and have it put in writing. Whoever has custody of you right now will do so until you are 18 I believe.

No but if you tell your mom that you want to live with your dad she should let you you can always go to the court and tell them that you want to live with your dad but you would also have to ask the court to give you a guardian ad litem :
Most states, the Guardian ad litem is a volunteer appointed by the court. The Guardian ad litem speaks only for the child in the child's best interest. In your case, I would say yes, to go for it. If not, its your word against hers and in a custody case you wouldn't want that.

You have to stay with whoever the court gave custody to. but if your mom don't come after you then your all set at dads should let her know what you and your dad have planned

u should take it to court because your mom could get you for running away or your dad for kidnapping but if u take it to court they will probably let u chose who u want to be with.
