I don't want to keep her from him, because I know she loves him very much. I grew up without a father and I don't want her to have to go through the same thing. I was just wondering if that is an option to get him to pay. Thanks!!

child support and visitation are always two separate issues, and treated as such in court.
he gets to see his child(ren) no matter what he owes.
if he doesnt pay, you contact your caseworker. they schedule enforcement hearings, etc etc.
the state and federal government are tired of people not paying for their kids, so they passed stronger laws against deadbeats. your best bet is to learn all you can regarding your states child support laws. ALL of 'em.
every state is slightly different about it, but its all still stronger.

Don't withhold his daughter for non-payment that just makes you look bad. But don't believe the person who said IF you do keep her from him he doesn't have to pay. That doesnt make sense. Visitation and Support are two seperate issues. You cant have it one way and not the other. But you can get the courts to make him pay - you need to complain over and over until they get so sick of you that they finally do something. Talking to your caseworker supervisor always helps get the job done. Good luck. Every child needs both parents in their lives and the support of both parents.

Yes he still gets to see his daughter. You can't stop him from seeing the child if he doesn't pay. You need to take him back to court for that. However, if you keep his daughter from him he can inform the courts of that and with hold payments until his visitation is restored. Don't keep the child away from him, that will just look bad on you when you go back to court.

Talk to your lawyer, as it varies from State to State, but in general, no...if there is a Court Ordered Child Support Order which he is required to pay (and in most states, garnished from his paycheck) he has to pay of go to jail. You likely could have him arrested if you have the above if he is in arrears, but then you have to weigh you daughter seeing her Daddy being arrested for wanting to see her against receiving money for child support. In the long run, your daughter is likely to need to know her Dad loves her more than he provided money to support her, but that is your personal decision to make.

Child support and visitation are looked at as two seperate issues. You need to get with your child support agency over the support. But he still has a legal right to see his child. ......Child support is not the payment of a fee for visitation.

Child support is not payment for visitation rights so yes he still gets to see his daughter. However YOU have to go to the D.A. with the order of support and tell them he is not paying his child support. If I were you I'd also file for welfare for the child...then the STATE will go after him for child support as well as repayment for the funds they paid out due to his non-support.

take him to court have him served at work to let his co-workers know what kind of father he is and more important do not give up the feds will take his tax refund for past child support owed as for the child seeing him thats a tough one the knee jerk reaction is to say no but he is her father and she misses him i am sure so for her sake i would let her see him.

I think legally he is allowed, but personally I'd say no. Also there are agencies out there to help collect child support & have it taken directly from his pay.

You can't keep him from seeing his daughter BUT you can take hime to domestic relations and they will force him to pay support.

No, You take the ***** to court and the judge will make him pay you your money. Cuz hell that's what I would do. Good luck getting your money. Hope all goes well.
