I have sole legal/physical custody of my 9 yr old and 6 yr old. My ex is supposed to pay child support, but hasnt paid in almost a year. We have insurance, but anything uncovered or not fully covered is to be split 50/50. My 9 yr old is supposed to get braces, but if i cant get $300 in child support, how am I supposed to get $1000 to help with the braces? I realize I'm probably being a b*tch, but I'm sick of him sliding by doing nothing while my new husband and I pay for everything. Between insurance and the FLEX plan I have at work, we can cover the whole cost of the braces, but I want the ex to put in his part. How can I make him help with something his son needs?

how hard up is he? its more how lazy is he... his power was cut off back in november, and as far as i know, its still not back on, and my son says the bill is only $110. he lives on his dad's land in a trailor that was given to him. he works when he feels like it. i honestly think hes cooking or dealing drugs, but i dont have proof. basically hes just a sorry excuse for a father. the boys have played sports for the past two yrs and he hasnt come to one game. he'll give up his visitation instead of coming to watch them play.
as for the FLEX plan, thats not insurance, so i dont think that has anything to do with it.

How hard up is he?

Send him the bills, send carbon copies to your divorce lawyer, social worker ec (whoever drafted the agreed upon arrangement).

Rack up the bills and copies. Build a file folder.He might be able to pay next month etc, Until then consult with the lawyer for your legal alternatives.

This is about more than the braces. This is about his continuing disregard for the law saying he was supposed to support his children.
Either haul him into court over it and get his wages garnished, or let your insurance pay for it.
But, you know, if your insurance and FLEX plan at work are covering the whole cost of the braces, then it's not an uncovered expense and the court will probably say that he doesn't have to pay half.

You should definitely seek the advice of a lawyer. That child support order needs to be reinforced. You should not have let him go this long without paying child support.

Awe, i am a kid who went through this with her parents... my father alway promised me that he would help pay from my braces... but in the end... i got adult braces, that I am paying for myself...without the help of my parents....

Go after him in court. Make sure it is a legal obligation so the state can garnish his wages!
