Me and my girlfriend are waiting for our first baby in Florida State. However, my girlfriend is married since 2 years with another man (marriage was in California State). She will start the process of divorce but she will not be divorced when the baby will come.
How does it works for papers and for the paternity? What is the procedure for me for the paternity?

My sister is actually going through this right now.You can give the baby your last name but to the state of Florida her husband is actually the father. You have to petionion the courts for a paternity test after the test proves he is not the father and that you are you will be able to sign the birth certificate. Sounds messed up I know. It should not take long, as long as no one contest the divorce and they both just sign the papers. Good luck and I hope every thing works out for you.

You should be able to sign the birth certificate, however if the husband wanted to make trouble for her, since they are still legally married he could make a whole legal mess for the two of you because the child could be considered a child of the marriage and he could claim that the child is his. This would probably ultimatly lead to a paternity test, wich would prove you to be the father, but it can be lengthy, and costly ordeal. Why again is your girlfriend still married while expecting your child?

all you have to do is sign the birth certificate!
