If you are in custody, they cannot hold you longer than 72 hours. They need to either schedule an arraignment prior to 72 hours, or release you.

However, after 9/11/01, The feds can hold you for as long as they want, as long as exigent (emergency) circumstances warrant it.

If it is the state police, it is normally 24 hours not to exceed 72 without being charged with a crime.

Federal laws are different in that it depends on what you are being questioned for... if it is national security related, they can keep you indefinitely.

The police can hold you for a certain number of hours depending upon the crime you are being suspected to have committed in your place. The maximum is 72 hours if suspected of being a terrorist in our place. If no evidence is gathered and the case cannot be filed in court, you will be set free.

What the law is and what they actually do are 2 seperate issues. Some cops think they're above the law

well it depends on what they are asking most of the time it is 24 hours ask for a lawyer the minute you walk in then you are protected for yourself.
