The dentist accidentaly sliped the instrument on my lip when he was sanding the new crown, and the cut quickly became cold sore, which I never had it before, and one of the nurse had cold sore a couple of weeks ago, and it kept reoccoring, and I have all the pictures, and so does the doctor.

You can sue anyone for anything. I would first report that the dentist is possibly using dirty instruments to the Dental Board for your state and have them investigate. If everything is clear then more than likely it wasn't a dirty instrument being used. OSHA will update you on the prgress of the investigation and they will make sure all of the violations are corrected.

I think you have every right to sue the dentist!! That sounds like pure neglect on his part!! Your teeth are so important to your over all health and you need everyone of them!! Shame on this dentist, if word gets around he won't be in business very long!!!

You did mention he "accidentally sliped the instrument"
Cant you just forgive him?
Also, what cause him to accidentally sliped this instrument?..Did you accidentally move your hands to scratch your nose?..Did you accidentally make a gesture that cause the dentist to lose his concentration and sliped the instrument?....Do you really think you can win this lawsuit?...cuz you know the lawyer will still charge a consulting fee.

Just because you signed a consent to "perform a procedure"doesn't mean you sign away your rights away. If the persons at the Dental office has caused a injury,they would be held liable,and yes you could take the case to court.You should seek the advice from a attorney to see what your options are and take it from there. That's rich. that's a good one. There are dentists getting sued over a lot more than that everyday and getting off the hook. In fact the more they are sued the more synical they become. They place bigger adds they place and get richer. Please don't do him any favors. That lawsuit will be thrown out in a heart beat.

Yes but you need to prove it and get a lawyer. Which can be fairly expensive. Good Luck.

What damages did you suffer?

If you hate your dentist enough that you want to sue him for "accidentally" cutting your lip, I think it's time to just move on to another dentist.
