I am a single mother of two little boys (4 and 2) in which I have sole custody. They have a very "lazy" father who never finds it convenient to see them. I live 45 min away from him and he only comes to see them about once every two months. I have been divorced for almost 3 years and I have met the love of my life and moved in with him. ONE PROBLEM!!! He is in the Air Force and with that his job takes him all over the country. Well if he ever gets sent to another base I of course want to go with him and by then we will be married. But I got a call from my ex today saying that he is doing some sort of petition through the courts and if its approved in 6 months then I will never be able to leave the state of Georgia. I have researched and I cant find this "petition." But the only way it will supposedly be void is if I am married before the 6 months are up. I would willingly marry my boyfriend but he thinks there is a way to get around this. If anyone has any advice please send it my way.

Dont know of any petition like this. To move legally with the kids you will have to either;; 1. get written notorized permission from dad to move the kids out of state or 2. petition the permission from the courts if No. 1 fails stating the facts why this would be in the best interest of the children and explaining any visitation proposals involving dad if he desires them. You can always contact Georgias legal aid assoc. and ask them about this petition or if your husband is just making things up

When I got my divorce my lawyer told me I could move anywhere I wanted... and we had "shared" custody with me being the custodial parent! Of course like your ex, mine never really wanted to bother with his son (unless he was in the mood to aggrevate me). We moved. No problems since.

I do think I've heard of something like that though and he's probably only doing it to **** you off, not because he wants to see his kid.

If I were you, I would NOT pressure my bf into getting married for THAT reason. You could end up causing all kinds of problems for yourself... See if there are any legal aid organizations or better yet, talk to a family law attorney who offers a FREE initial consultation. (Don't tell him you won't be coming back!)

I think the courts will stand in your favor due to the fact you state he only sees them every two months. You have custody so that is in your favor also. This very thing happened to my cousin his x g/f took off with his child and he had no say he was not paying child support.

i am not sure about a petition but some judges can make you stay in the state if your ex can prove its a hardship for him to visit,get a lawyer and fast its just a way to control your life.

bronzebabekentucky nailed it - PLEASE get a lawyer IMMEDIATELY! Do not trust the custody of your children to anyone other than a legal expert; and do not wait for him to file some sort of legal action first, 'cause then you'll have to answer his legal action before you can start your own.
