a person gets hit by a car...can his lawyers claim depraved indifference?

Although the intent may not have been to cause harm, the acts were those of extreme recklessness.

For example a person hit by a car when the driver of the car, while not intending to harm anyone, nonetheless engaged in a street race and should have know there was a possibility of damage to people or property as a result of his indifference to safety.

Depraved indifference basically means that you're out there doing things with no apparent concern for the health/welfare of others who may be around you. You don't necessarily have to be under the influence to act that way.

depraved means "without morality" indifference is the "i don't care" attitude. putting the two words together implies a person who is only concerned with what he/she wants and the rest of society is as important as a swarm of mosquitoes.

This is a mindset commonly found among drug addicts.

Sounds similar to reckless driving. You would have to prove someone was operating in a reckless manor with regard to human life. Sounds like it's time for an attorney.
