I was seperated from the army under chapter 14 general with honarable conditions for failing a urinalysis. I probably would have been retained as i requested during my article 15 hearing but while on extra duty i broke restriction and left base for a night. I was subsequently court martialed for disobeying a direct order and my discharge was carried through. On my dd 214 i have a re code 3. I was also made to sign papers during my court martial ,one which said i was inelligble to reenlist for 2 years. Its been one year and i really want to rejoin. what are my options and can i ??

Good luck on getting the waiver. Try to find a recruiter who is desperately behind. Otherwise they are not going to waste their time with you.

RE code 3 is waiverable under certain conditions, but if you were given papers that specifically said "two years", then you are probably out of luck. Never hurts to try, though.

Take your DD 214 to the recruiter and tell them the full story. If you meet the specific criteria for a RE3 code waiver, you'll need to do a memorandum explaining what you did and how you've changed, and you'll be interviewed by 2-3 commanders and staff officers in at the recruiting company and battalion levels.

Good luck with it. Hope you've learned from the mistakes. That's the main thing they'll be looking for.

if your DD214 has a SPD code showing discharge for drug use, you will NOT be able to get back in, even with an RE-3 code.

RE-3 code just means you require a waiver. However, a waiver will ALWAYS be denied if the discharge was for drugs.

For a true answer, it would be best to contact a recruiter and carry all the documentation you have. He/she can get the answers you need.
