and the salesman, who happens to be my boyfriend's cousin, told me he would not cash it till the money was in the bank. My car had just broke so I HAD to get another car and was waiting on a check to go through at the bank. The check I wrote to him will be okay to cash tomorrow, BUT. 2 Days after I took the car off the lot, I noticed the power steering was messed up and talked to the salesman. He had told me when I bought the car that the warranty covered EVERYTHING! Now, my car has been in their shop for a few days, not fixed, and I have a rental. I am now being told I am going to be charged for it getting fixed. I was thinking of putting a stop on the check I wrote before he cashes it, and leave the effin car there. I know I'm in a contract, this is the first car I've bought and I don't know what to do. Is there a return policy on most cars? lol I know it's dumb.. but I need advice!

ALWAYS, ALWAYS, ALWAYS get it in writing.... If they just told you by mouth that everything was covered, then (no offense) but you pretty much asked for it... If they told you that in writing however, you can take them to court over it or whatever needs to be done.. Read over your contract, see what it says and what it doesn't say, and use it against them..

While it doesn't seem right and this situation probably only happens once every three years at any particular dealership, this can actually happen!! It can take up to three weeks for financing to go through depending on the lender. Even though, the financing company probably already approved the loan prior to delivery of the car, they may have come across some information that made them change their mind. I worked in a dealership for 5 years selling cars and only ever saw this situation once. It is not a situation a dealer ever wants to get into, they end up looking like the bad guy, the customer is livid, and the finance company has both of them by the balls. I wouldn't wish this situation on anyone. Your friends best bet is to get an attorney and try to work something out with the dealership.

if it is still under the factory warranty of 3/36k it should be covered. Unless it was due to neglect. If it is not under the factory 3/36k It wont be covered because the 75000 mile Limited warranty only covers 29 items of the power train! Power steering is not part of the power train. The finance manager should have given you the option to upgrade to the ESP PREMIUM CARE WARRANTY! Which only costs $475.00 more.
That deal is already funded through Ford being that you bought the car 16 days ago! It would be pointless to stop payment on the check. Because it has been over 2 weeks. If you do stop payment on the check, the dealer can legally send you to a collection agency for the $1000. check!

I know this because, I am a finance manager for a Ford dealer!

If your in a contract, there is no point in stopping the check. They will simply send you a bill for the entire cost of the car. And that will sit on your credit for 7 years if you don't pay. You should know that NO warranty covers everything, especially the power steering, that is something that has problems after wear and tear. However, since you had JUST purchased the car, you can threaten to report a LEMON to the BBB (better business) and let the dealer know that unless they replace the vehicle or cover the fix-it costs you will be suing them under the Lemon Law. Do your research you have a right to buy a car that is up to standard. But don't stop payment, that is just asking for problems.

The problem was that you had brought a Ford? lol just kidding, i 'm a GM girl,
Is the car brand new or used?
Used = as is warranty = you pay for repairs
New = warranty = lemon law

Do you have anything in writing for the warranty ? Did you read the contract/? This a must when dealing with the dealer on the repairs of the car. The dealer must honnor the warranty contact.

You may have pay for the decutcblie for the rental and labor, certain parts of the cars) which sometimes are not in the warranty contract. (the warranrty probally did not cover power streering ,) .

Find out what warranty you were given, if any. Most places give a 30 day warranty. They have to honor their warranties. If they don't, report them to the Better Business Bureau. And, put a stop payment ASAP before they cash the check. You need to play hardball with them.

like some one said above stop payment on the check NOW and tell the mechanic to bill the dealership. We have laws against such things here in Canada,It would not stand up in court in the states either. You put money down on a warranted car and did not finalize the deal so the dealer ship is responsible for all maintenance costs.I had forgotten about this happening to me 20 years ago..until now...thanks..lol

Miss Ally:

Fist thing off the bat is read your contract, you should have a 72 hour return policy. if that don't help invoke the LEMON LAW on the car dealers butt and see what they have to say about that.
If they still fight you go to the better business bureau. Also I would put a Hold on that check that should get their attention.
hope this helps

Put a stop on the check if you can before its too late.

If they don't hold up their end of the bargain, then you don't have to either.

Put a stop on that check and then you're back in the position of power when it comes to bargaining.

BTW - What kind of loser is your boyfriend if he's not taking care of this for you, considering its his cousin who's the salesman?

Stop the check, Forget the car, and dump your boyfriend.

tootles!

What is the year, make and model?
If you bought the car "as is" you're responsible for anything that breaks as soon as you drive off the lot.
