My father claimed me this year as a dependent, yet this year I made all my own money, I paid him rent, and even gave him grocery money for me! I drove his car, but paid for ALL upkeep. (Including insurance) And he does not have a house payment. He told me since I have lived with him and I did not pay for the electrical bill and HIS expenses that I was his dependent. Is there some thing on the IRS's website that can show me if I am in the right or if he is in the right? I would like the extra $700 from my return, but I just want to be sure that he is not breaking the law.

If you were 24, as of 12/31/2006, a full time student, made less than a certain amount (can't remember the figure off hand) AND your father provided more than half your support - he can claim you. ALL requirements must be met.

Sounds like he didn't provide the final requirement. If he didn't provide half your support, he CAN'T claim you.

There is a worksheet for calculating support on page 32 of IRS publication 17 - you can download it at irs.gov

If you are over 18 and are not a full time student, he can't claim you as a dependent. Even if you're under 19 or are a full-time student under 24, he can't claim you if you provided over half of your own support, even if you did live with him. Not paying for HIS expenses has nothing to do with whether you are a dependent or not.

Go to a tax agency like H&R, they will answer questions and you don't have to pay them for anything. If he has already claimed you, it is too late to do anything about it. I think that you are a dependant as long as you are under 21 (in most states) and living at home, and if you are in college you can be claimed until 24. Unfortunately, since you cannot prove that you pay your dad money, he can claim you.

You cannot claim yourself as a dependent if you are being claimed as one on someone else's return.

Visit the website irs.gov

Search for dependent, find the explanation, and print it. Show it to your father.
