Okay so it is a friend of a co-worker. The dude is from Portugal (sp?) and has been here for 6 years. Apparently you have to have your employer sign the visa for you to stay here and throughout the years when ever it gets renewed the same person has to sign. I am not sure if that is true but apparently the guy who signed the first time has moved out of the state and therefore they can not get him to sign it again. So guess thier question is can someone else sign? Like his new employer?

Generally, your friend should depart from the U.S. as soon as possible. Remaining in the U.S. beyond the period of authorized stay, and/or continuing to work in the U.S. without status can subject your friend to removal procedures. However, it's difficult to provide an accurate analysis without knowing more about your friend's situation.

Furthermore, if your friend continues to remain in the U.S. beyond the expiration date listed on his or her I-94 card, he or she may be in danger of being subject to what is known as the ''3/10 year bar'' for unlawful presence. Unlawful presence is defined as being in the United States after the period of stay authorized. If a foreign citizen is unlawfully present for six months, and then departs, he or she will be barred from returning to the U.S. for 3 years. If a foreign citizen is unlawfully present for a year or more, he or she will be barred for 10 years.

He has one valid determination here. Marriage to a US citizen will enable him to regulate his prestige and stay interior the U. S.. via fact that he definitely got here to the U. S. with a valid visa, and became inspected on the PO, he won't be made to return to Jamaica with the intention to do the interview, as different persons are required who on no account had a visa to start with. He rather has no different real looking techniques at this factor. If he's deported he will have a ten year ban located upon him, and he won't be returning to the U. If they are in the USA they should leave the country and make sure it is documented. Then they should sneak back into the country because the US gives illegals all kind of rights. People who jump through all the hoops to get into this country legally can be deported at the whim of the INS.

They should have already applied months before, they will probably be deported
