need to know what kind of evidence to show the judge to tell him that it was totally impossible to get that ticket because my mazda 323s 5 spd trany was out and i was only going back and forth to work only in 2nd gear

Did you ask to see the radar when you got pulled over? Maybe have a notarized statement from your mechanic saying that your car is not capable of going that speed do to its mechanical condition.

Before you start yelling "Foul Play" you need to state what the speed limit was and then how fast you were going.

My own car can certainly go 40mph in second gear. Therefore, it would be interesting to know...was the ticket for going 40 in a 25 or what?!

As for the officer allowing you to visually inspect the radar equipment. IF an officer allows you to view the radar...he is doing it out of the kindness of his heart. There are NO legal requirements for the officer to show a radar reading.

You need to remember....radar is used to "enhance" the officers initial observations based upon his experience. He observes you traveling faster than other vehicles or based upon his experience can see you are obviously traveling in excess of the limit....he checks the radar equipment and "verifies" his initial observation and notes you were or were not speeding.

The radar equipment is not "direct evidence" and it does not sit on the witness chair to testify in court....the officer does.

If you have equipment failure...the judge will certainly find reason to penalize you for that...as you say you have a faulty transmission!

In all honesty...my suggestion is that you look yourself in the mirror and ask yourself if you were speeding...if you answer honestly....pay the fine!
