If God doesn't see the difference, why should the law, and if you have only the bible to go on to know that rape is wrong because it is 'fornication', than how do you make the distinction that rape is a crime against humanity, and how do you compare premarital sex to this?

Apparently you have no understanding of the bible and this is more of a challange than an actual question but I do know the answer so I will answer it for you anyway.De 22:25
But if a man find a betrothed damsel in the field, and the man force her, and lie with her: then the man only that lay with her shall die:
De 22:26
But unto the damsel thou shalt do nothing; there is in the damsel no sin worthy of death: for as when a man riseth against his neighbour, and slayeth him, even so is this matter:
De 22:27
For he found her in the field, and the betrothed damsel cried, and there was none to save her.
De 22:28
If a man find a damsel that is a virgin, which is not betrothed, and lay hold on her, and lie with her, and they be found;
De 22:29
Then the man that lay with her shall give unto the damsel's father fifty shekels of silver, and she shall be his wife; because he hath humbled her, he may not put her away all his days.
This is not fornication for the woman because she was forced and cried out for help and there was no one there to help her so she was not willing,it is a matter of the heart,.
So the answer is no she is not guilty of fornication if she is forcedor in modern term raped

Well, no offense, but your question is not written as clearly as possible. What you are asking is a question of moral action theory, and there is no text in the Bible that even brings together or compares rape and fornication.

So when you say that "you only have the bible to go on to know that rape is wrong because it is fornication", you are not being accurate. Fornication and rape can both be labeled adultery, but nowhere in the Bible or anywhere else does it say that they are the same thing. Of course rape is worse and different, because it is a different action. We have to use our human reason and understand that.

The Bible doesn't address tax money laundering either, but we can understand from the text that stealing is wrong, and from there make judgments about various forms of cheating people, and understand that some are worse than others.

premarital sex is basically defined as Fornication.
Most fornication is usually by Consent.

To avoid fornication a Man must be married to a wife.

but if a wife Is truly being RAPED by her husband against her will then she must first tell the husband not to do it, because it is against her desire, then she can go to the church and the elders and apply for a divorce and then go to the police and press charges.
There are women organizations that help homeless women who are in need of shelter from an abusive husband, Mainly for these kinds of reasons.
the bible does not condone abuse or Rape. it is unrighteousness

however it is a sad thing for a husband to marry a woman that does not love him, and it should not be required for a man to continue in a marriage where sex and children are absent without consent. A man marries a wife because he believes he loves her, and is trying to be faithful to the commandments of God and the gospel of jesus.

God does see the difference. Rape is a crime, to both God and man. Premarital sex (fornication) is a sin.

who said that God is gonna account you for an act of rape. Read the bible yourself and stop listening to everything you hear. That's what's wrong with people today they are listening to everybody but God. Read His Word, it'll tell you this stuff. Do you actually think God is some evil being and will judge you because you were abused and rape. Rape is sex against another being's will. Come on get real, my God is loving and is sensitive to the needs of His people. Listen to Him, not people who don't even know Him.

What is your problem? This is how many questions now that you are trying to slam Christians in one form or another? Why are you so hung up on rape? Are you fantasizing about being raped? Or are you just into slamming Christians because you have a sad and pathetic life due to not believing in Jesus Christ? You don't have to be jealous of Christians you know. You can accept Jesus as your savior and adopted brother and be saved just like the rest of us. Come on and join the party. Heaven is the coolest place you will ever know. The place for the unsaved is to say the least very uncool and definitely no fun.

I am a christian and as far as I am concerned rape is rape and premarital sex is fun. In rape only one person has had a choice and that is the offender, the rapist is the sinner and law breaker here. These two subject shouldn't even be brought together. They are so vastly different.

Having only the Bible to go on I would have to say that, according to God, both are a sin, punishable by death. The difference between the two is this...

Rape is a decision made by one person. That person is violating the most intimate area of another person's life. Using the Bible for reference, it says in Deuteronomy 22:25-26, "But if out in the country a man happens to meet a girl pledged to be married and rapes her, only the man who has done this shall die. Do nothing to the girl; she has committed no sin deserving death." Rape is when only one person involved is willfully committing the act. A little further back in the same chapter of Deuteronomy, verses 23-24 says, "If a man happens to meet in a town a virgin pledged to be married and he sleeps with her, you shall take both of them to the gate of that town and stone them to death - the girl because she was in a town and did not scream for help, and the man because he violated another man's wife..." Obviously these verses do not cover every possible scenario, but they do give an idea of the differences between a willful act by both people or by just one.

That being said, premarital sex is wrong because it is the willful act on the part of two people who are not under the sanction of marriage. God's Word forbids this as well. The only difference between the two is the way that "people" handle these offences. Our society has decided that premarital sex is okay, "as long as it's done safe," and that rape is wrong. Both are a sin in God's eyes and both are punishable by death, according to His word.

In Romans 3:23 it says, "For all have sinned and fall short of the glory of God." With God there is no distinction between one sin and another. Because He is holy, there can be no sin, whatsoever, in His presence. As stated in the verse above, ALL have sinned. Take a look at the ten commandments... Have you ever lied, stolen anything, committed adultery, made anything other than God your main focus? Since you brought this question from the standpoint that there is a God I assume that you believe in Him, if that's the case then there is hope in the fact that He sent His Son to die that all our sins might be reconciled before God. John 1:12 says, "Yet to all who received Him, to those who believed in His name, He gave the right to become children of God..." This is the only solution that God gives to any sin, whether rape, premarital sex, or even something as "small" as a lie. Not only that, but it says in 1 John 1:8-9, " If we claim to be without sin, we deceive ourselves and the truth is not in us. If we confess our sins, He is faithful and just and will forgive us our sins and purify us from all unrighteousness."

I apologize for going off on a tangent, but back to the original question, the only distinction made between the two is who is at fault, whether both entered willfully into it, or if it was forced by one person upon another. In the case of rape, the violator is the one at fault and, according to God, the offense if punishable by death. As for premarital sex... it's really not worth it. God designed marriage for a reason; part of that reason is to fulfill the desires of a man for a woman and vice-versa. God also considers this sin punishable by death. Besides, if you waste yourself before marriage, what do you leave your spouse when you do get married? Nobody likes getting second best, for that reason I've decided to wait for my future wife. I'm 18 and I've never even kissed a girl! Someone once said that, "Good things come to those who wait." I'm trusting God on that one!

By the way, I am a Christian, and I believe that the Bible is the infallible Word of God, inspired by Him and acurate in its entirety.

No. Rape means there is an unwilling party. God would certainly not hold a victim to be guilty. His judgements are righteous.

how can you as a woman be so insenstitive to something as brutal as rape? Of course it isn't premarital sex, one can only have "sex" if both parties are consenting. That said, I do believe oral sex is a form of sex if both parties are willing.
