I'm living in England on a voluntary workers VISA, but we are planning our wedding for September 2007 to be held in the US. We will then be staying in the US, living in Chicago. Can we skip the K-1 Fiance VISA and just apply for him to get a green card after we have our wedding? He will be entering the US 3 weeks before our wedding takes place. Is this legal? What are the chances of the US allowing him to enter as a visitor with no VISA?

The only problem is that if the immigration officials at the airport suspect that he is coming here as a visitor, but really to get married, he will be deported immediately. Also, if at the marriage green card interview, if the interviewer suspects that he came as a visitor, but really had intent to be married all along, that can cause problems too. My husband is from the UK as well, and nowadays it is very hard to come to the US from the UK without a visa. It's quite simple to get a B visitor visa, so I would recommend he get one, so at least on paper it's all legitimate.

Also, I would prepare so that it looks like he is really just coming here for a visit and on the spur of the moment, you decided just to get married. I would suggest getting married in Las Vegas or something. And then start planning as if YOU are planning to get married in the UK in September and live there. Start calling places in the UK about wedding venues, etc. about living in the UK, so it looks like he is really just coming for a visit to help plan the wedding preparations, and not really to marry.

If he enters on a valid visitor visa, then get married asap and file the papers for an adjustment of status for a green card marriage before his visa runs out.

You need to contact the embassy and ask them. As he will be married to a U.S. citizen, he is entitled to certian excemptions. But it does get complicated. If he choses to become a U.S. citizen there is a bunch of paper work to fill out, but that is really the best way to go if you are going to stay in the States.
