A friend of mine has been caught driving without a license or insurance on his car. It was obviously confiscated and has been scrapped as he cannot get it back.

He has a provisional license.

He was in court back in 2004 for the same thing and just had a 4 month ban and a fine (cant remember how much).

What can he expect to happen this time as hes cocksure hes gonna get the same but I'm worried he'll be sent to prison.

Any advise would be gratefully received. Even better if anyone has had this experience.

Can I just thank everyone for their views and opinions, and stress to people who are being nasty that this is actually is a friend and not me. I dont think I've ever broken the law in my life, I'm too much of a wimp to even contemplate it.

Doubtfull he will go to prison. I am a driving instuctor, and i see people all the time with multiple bans and huge fines. Prison is generally a last resort, and if he hasnt injured anyone or damaged any property he should be ok.

EDIT - Im talking uk here, not idea about states or rest of world.

It depends on the magistrate, what sort of day they're having, whether they dislike people who commit motoring offences, or whether their forte is in another area. Just from experience I'd say he'd probably get an 18-24 month ban and a fine of around £600. If he does it again after that, then I would guess he'd be looking at prison. You're his friend - you're in the best position to try and make him see the error of his ways. Just think, if you manage to get through to him, you'll never know it, but you may have just saved someone's life. Good luck.

In my experience dealing with these kind of offences the punishment is usually 18 month ban with £500 fine. The ban can be reduced to 12 months if he goes on a driving standards course which the court will arrange.

There is not much he can do to get it back.....he shouldn't have been driving in the first place. Do you have a license?

There have been so many wrecks on our road since they put up a stop sign, many people seem to think that it just means slow down, or something. A school bus came through and the guy ran the stop sign and got hit,,,,,,who's fault is that one.....the school but going through a through street or the guy that ran the stop sign......

I stopped and told the police officer there that so many people don't stop there because its a new stop sign but he told me that I have to bring it up with the city.....

My point is, people get into a car and think they know what they are doing. The licensing is a test that helps people know the laws before they are speeding through school zones, or whatever.....

I live on a side street, but my son attends an elementary school on a main 45mph zone, which is 20 when the light blicnks....do you think people slow down for my child? You are right, they do not......I have to put my blinkers on for people behind me to pick up my child from school, even though it is ridiculous I should have to do that in the first place.

Re-banned and fined more than last time.But this is totally inadequate.He should be banned for life and sent to prison for a long time.He obviously did not learn his lesson last time.
I am a coach driver and I have to work on these roads which are full of idiots like your boy friend

Sometimes it does all depend on the judges mood that day in court ! It's really not fair ....but i think he might need to do a little jail time ( i'm not sure where u are ) ....or he could just get tons of fines !!

Good luck and don't do it again ...it will make the future really hard for him !!

Really all down to the discretion of the magistrate. Unfortunately you read about persisent offenders like this getting fines and community service which is obviously not much of a deterrent. The issue of overcrowding in our jails is a serious one and if your friend is not deemed to be a serious criminal then he may get off again - It's difficult to predict.

A wan**r just like him totalled my pride and joy and it took years to get my money back cos he was'nt insured. Luckily, when that happened no-one got hurt - but they easily could have been. What if he had killed someone? Everyone else has to pay for lessons and a test and insurance - what makes him so special? If I was the beak he would definately go to prison - but sadly, there's no room.

Every State is different - our Texas Penal Code is strickter than most - if you don't have your TDL or Insurance when you are pulled over you automatically go to jail & your vehicle gets towed - no leniency here!
