So Im sitting at the lunch table and my friend out of the blue says, "Did you know you can go up to a cop and tell them your high and they cant do anything about it if you dont have anything proof on you?" And I said,"Thats not. If you appear to be under the influence of drugs they can test you Im almost positive." The reason I said this was because I was watching this guy get a sobriety test on cops and he went through all these tests and he was doing really well. Him and the cop were talking, and the man is like, "I'm pretty good for someone whos been drinking." So the police offer says "Well looks like your coming with me" I know its not really the same thing.

TO SUM IT UP....
If a cop sees you could be under the influence doesnt he have the right to check you?
Any one a cop or anything?

If the officer suspects you are under the influence, yes he has the right based on public intoxication laws.

Anyone who admit to a crime to a cop is an absolute fool. Of course the cop can arrest him.

You can use the Fifth Amendment - meaning don't comment on your guilt or innocence.

A good cop can always come up with a reason to detain and arrest anyone, regardless of who you are and what you are doing.Tell your friend to try it and see what happens.

it is not illegal to be intoxicated on a legal substance but it is illegal to be so in public. so yes you can get in trouble if he believes you are being a nuicence in public or a danger to someones person or property. by approaching a cop like that it could be considered a nuicence.

public intoxication is illegal, so you can be detained and arrested, then tested.
