If someone sets up a myspace account under a false name and gets information on another person that can be used against them, is it admissible in court? I recently found out that the person my ex is with is smoking weed on the weekends when they're in town and I was just seeing if I could use it. She admits to it on a message she sent back to me. He's supposed to have my son on the weekends but I don't want my son exposed to that kind of thing, especially since he's only 8 years old.

If you can print it, you can use it. Document everything your ex and his girlfriend do and say to you and ask pointed questions of your son and write down his answers. Write down anything he says about what his father and girlfriend say and do, how they act when he is there. Leave absolutely nothing out. Give it to your lawyer and make sure you let him/her know that you are not letting your son go there until such time as the drug use stops.

I would use it. Print it and the email where they admitted it. But courts are not that harsh on someone smoking weed because so many people do it and it doesn't affect them the way they take care of their kids. Get them to admit that they do it while you're child is there. I would also ask the courts for him to have to take a drug test. A little fyi try to be seville with you're ex. I have a nine year old and her not seeing her dad really affected her mentally. So remember no matter how much you don't like you're ex think about you're son. You have to do what's in his best interests no matter how you feel. Good luck!

OK this is in ALBERTA CANADA NO because I went throw it and NO way I had pix's and his friends doing drugs with my kids sitting right at my table with my X and I even tryed to take it throw the courts he even admitted to supplying drugs to my kids and their friend in a court of law and he walked out of the court room with all 3 girls after all of that the courts told me as long as they are 12 or older they have the right to decide were and who they want to live with which I think it was wrong but that is how it works in ALBERTA CANADA THAT IS OUR GOOD LAWS FOR YOU HERE .
