A old credit card was picked up by a junk credit card collector. He cannot supply any information towards the account. They went ou to get a Lawyer to try to collect. What can the Lawyer do without any information. The Junk debt collector holdsany information. What type of information should the Lawyer supply to me to make a case of this. The debt was written off or closed on credit report by both the creditcard and the Junk Debt collector. What can the Lawyer do when case is presented to Judge

Then they cannot bother you to collect. They cannot report it to the bureaus as well. If they do, they can face fines. Please scroll down past the add and see the exact items that will cause them to be fined and for what amount.

If the original credit card account is more than 7 or 10 years old (depending on your state, you need to check this for certain), then the lawyer cannot even litigate the debt due to the age of the debt and the fact that the debt has been charged off by the original credit card and the initial collection firm.

Your defense would be that the debt is too old to be collected under your state's laws. If you can prove that the debt is too old, you win.

The lawyer on the case would be an idiot to take a debt collection to court without an itemized statement or some sort of information that shows how the debt came to be. If/when you are served papers to show up for court you have an opportunity to answer them. And I would think your answer to the summons would be, please provide "proof of the debt", contract, itemized statement, invoices whatever the case may be. And if they really don't have anything - then they don't have a suit - period.
