so rick and adam are in a gym and adam makes fun of rick's shooting. Rick told adam to shut up, but didn't and rick ended up beating Adam. Adam ended up with a brokedn nose, so to get even he took his father's pistol and on the next day decided to shoot rick. So he waited until rick got into the lockerroom but he never showed up. Then all of a sudden the bell rang, and rick got scared and accidently pulled the trigger of the gun, the bullet hit a locker and bounced off and instantly killed a girl.

IS THIS a murder, felony, murder, voluntary manslaughter, or involuntary manslaughter and why?

It could be 2nd Degree Murder, that's what I would say. Since he had the intent to kill, but just not the girl.

All the previous answers you got were wrong. It's voluntary manslaughter. Adam was acting in a way that was irresponsible and the law states that in that situation, he is directly responsible for the death of the girl even though his intent was not to kill her.

If you act in a way that can reasonably be considered to be a danger to others (like waving around a loaded weapon), you are liable for the consequences. It's not murder because there was no malice aforethought. But it is voluntary manslaughter because it is unreasonable to wave a gun around in a public place.

There would be several charges...Involuntary manslaghter for the girl...Conspiracy to commit murder on wait...im not sure...because you say rick pulled the trigger...How did he get the gun off of adam?

I'd say involunteary manslaughter and depending on the state, the person would get about 15 years in prison.

Involuntary manslaughter, cuz he didn't try to shoot the girl, it wasn't premeditated murder.

The way I see it, it is murder. The intent was to kill someone. Just because the wrong person died does not make anything less. It is all in the intent.

Just my opinion.
