*sigh* it's a debate that's been going on forever, the right to search vs. the right to privacy. In fact, we discussed the very same issue in class a few months ago. Apparently, schools really don't care how you feel about the issue as long as they get a yes or no answer to the pill question. If she didn't take any pills, she didn't. 'Nuff said. As far as I know, it's still legal. But if it bothers you, try writing a letter to the school or perhaps even the superintendent. That should get your voice heard. I know, it's hard to have someone you know falsely accused of something they didn't do. Stick it out with your daughter, and good luck!

In this day and age with all the problems in schools around the country, most have taken a zero tolerance policy. I think the school should have notified you immediately. It sounds like they went about it the wrong way, but I do think they have a right to search her purse, coat, pockets, desk, locker. It is sad that we live in a world like this, but it's better to be safe than sorry. So many kids nowadays are abusing prescription pills and many are dying from it. Try to explain this to your daughter and that it was not a personal attack on her, although I'm sure it felt like it at the time. We have to try to keep all the children safe. I'd find out who started the rumor. This whole thing is that persons fault.

The law recognizes a school's right to do this, but they are ethically in the wrong.
Tell that school that you are trying to teach your child to live in a free society that follows due process, and that they are not helping by doing what they did.
Tell them that you will now have to explain the incident to your child in terms of the school's failure to understand the basic principles on which the US was founded.
Public schools are socialistic environments, similar to prisons, with sets of rules designed and catered to the very worst of their populations. An upright person forced to be in such a place could become confused as to whether individual morality is more important, or whether life is all about dealing with that which forces a person to do what is "right," and that which forcibly prevents a person from doing what is "wrong." Roosevelt, who founded the public school system and all the other New Deal holdovers that are the bane of true-blooded Americans.

yes its legal, but they need your consent for a drug test , yeah, its because it would take too long to contact parents in the case of an emergency. But they have to have reasonable suspicion, i.e someone straight up telliing the conselor that a student is popping pills. It is legal if the school thinks that any student poses a threat to the safety of the students they have a right to search your child's belongings. Your really not suppose to allow your child to bring pills to school because that's just against the rules. If she need pills then she should hand them into the nurse and go from there if she needs them. Its just a safety precaution. I'm sorry that had to happen to your daughter.

I believe the teachers have a duty of care to protect your child and other children who might come into contact with her. If they had reasonable grounds for the search I think you should be happy that they are doing a good job. However, I believe you have the right to ask about the circumstances that led them to believe your daughter might have something illegal in her possession.

If I am the father found out about this and I would demand to find out why did you just take her to the office and call me and I would come to over there and check it for myself and Found nothing and I would like to know who that kid telling about my daughter have you check them out with that plm??? have you check their locker or their thing in their pocket???
Have you notice my daughter is a stright a's student... I know my daughter how I know She and I always talk about what right and wrong and what good and bad and all that... I know my daughter every day.. and you don't just hear what other people say about my daughter and you take her out of her class infront of everyone?????
How would you feel If you in my shoes??? How would you feel if I did that to your daughter becasue someone told me that she is Popping Pills this mornign??? I would get a lawyer to find out when that policy and why was I not informed about this?? why??? I would find out more and If they said few months and few days ago or what ever who ever your friend's kdis go to same with your daughter and I would asked them if they said no never knew about that. then there is a plm... they always should informed you and other parents that new things in school and it going to be policy about this. You go see that guy i can't spell it but who take charge the school.. or see vice president and find out about this and if they said somethign is new and not know anything about this then would get lawyer...
that what I would do as a father... I don't blame your daughter not want to go to school... because of wht happen to her... wow.

I don't think it is legal for a school to do this. I think only the police can search your daughter. I think the school can only do this if you are present. Still, I don't know. I would call your police department and ask what is legal. I think your child's rights have been violated and you could contact the school district and threaten to sue. You might get an apology out of the school and hopefully they will change their policy. Still, it's a tough call. I would contact your police dept or a lawyer hotline for free legal answers to your question. Good luck.

Yes, sadly the school does have the right to search the purse. All schools require to be informed about any medication a student is taking. If they find out about any medication your taking without them knowing they have to find out.
