I have custody of my 2 daughters. One could care less if she sees her dad again. My other daughter thinks he is wonderful even though he doesnt see them that often.What is the age they can legally move in with their father?She wants to move with him but I wont let her. He leaves her alone and she is only 12.

Before you permamently split up the sisters, may I suggest a temporary live in compromise. Let the one girl spend the summer with her father to see if it would work out, being with dad and without her sister with her, etc. This way you will know if its worth petitioning the courts for a remodification for child custody hearing or not if 3 months doesnt work out. Its saves you money and your and the courts time, and in case it doesnt work itll save you alot of embarassment from the Judge. Just get some kind of written permission agreement between all parties so there isnt any legal formality unexpectantly jumping up and get it notorized for any unforeseen future court action. I have personally seen many of the same type situations go bad, and a above arrangement would have saved alot of problems. Good luck

Do you have legal custody of your girls-thru a court order? If so, her dad would need to file a modification in court for custody of your daughter. Most courts will listen to children once they reach the age of 12 when it comes to whom they wish to reside with, but the court would also appoint a law guardian to talk to your daughter. The law guardian will make a recommendation to the court based on her visit(s) with your daughter. This would also have an impact on any child support you may be receiving from him.

In most states the legal age is 12.

I am writing you to let you know that my sister and I went through the samething with our mother when we were the same age. Today I am struggling with similar situations with my children. I have 4 children. They all have different fathers and I know it's not much of an answer but WHY NOT?
