Last night about 3 in the morning I scene two cops walk up and steel my garbage. Isnt that steeling and is illegal and why would they want my garbage don't they have their own.

Also it gives them evidence to get a search warrant.

And fingerprints on the items often tell them.

and if you live in the same house, and know of a illegal item, you can be held guilty also

Stealing something you were throwing away? I'd like to see how long a judge would keep a straight face at THAT trial. The cops might just be looking for evidence about a crime that was committed nearby.

If the garbage can was on your private property (not the landlord's, if you're renting), they would technically need a warrant.

As to why they want to go through your garbage: evidence, from DNA from your mouth to names and addresses of people you get letters from or notes you keep for a while with names and phone numbers, printouts from your puter, what you eat, where you shop, etc.

The real question is, why are they curious about you? Or somebody living with you.

Oddly enough, even though your garbage, once put out for collection, is no longer "yours" or "private", they will still arrest people who go digging in it for cans in some areas. But, we all know that the justice system is screwed up anyway.
