It is whatever you want it to be. It is a vegetable because we eat it and it grows on a plant. It is a fruit because it is the fruit of the tomato plant. It is a vegetable because it tastes better with salad dressing. I vote for vegetable, personally.

Botanically, they are a fruit, just as zucchini, pumpkin, etc are. That is because it is the external seed pod that is produced from the flower of the plant.

Nutritional, and gastronomically, they are vegetables. That is because of the vitamins and minerals they provide. Also because of how they are used in recipes.
