I live with my grandma who adopted me and my biological dad. We moved here over the summer from Ky. We where living with my aunt. I turn 16 in may. We have talked and i can go live with her. My grandma wont let me because of my dad. He has no legal custody over me. Is their any legal action we can take so that i can move in with her?

There are a lot of unanswered questions here, but if you aunt feels strongly enough that she is the right guardian for you she could petition the court system for the right to have you live with her. Is there a reason why your grandma doesn't want you to live there? If your biological father lives with you and your grandma why doesn't he have custody/guardianship of you, maybe it is not a good environment. Good luck and God Bless.

If you post what state you live in I can help you get more accurate information. Whoever has legal guardianship of you is the "decider" of where you live. You can file for emancipation, which means that you will have to go before a judge and explain the situation, the judge will determine if your request is in your best interest.

Your aunt has to initiate a legal custody battle against your grandmother.

since you are a minor your grandmother has to be the one to let you go since she is the one with legal custody, your dad has no say in this, he gave up his parental rights when your grandmother adopted you.

You would have to go to court and have a judge rule you an emancipated minor. then you can live and do whatever you want. But be careful what you wish for ...sometimes you get it.

Listen to your Grandma. It sounds like she cares about you, and she knows what the situation is, better than you do.

You are old enough to make that decision, but would have to go to court and have them emancipate you.
