Good question in an ethics and an exercise in making people think differently. But.... to break it down.

They are of course brandishing a weapon and this is a crime. You would not know what their motivations are. Take the money and they shoot you for taking it or you refuse and they shoot you for not taking it. Either way there is a moment of fear for your life.

Now say a guy comes up to you, holds a gun to your head and hands you a briefcase with say $500,000 in cash. Then he leaves (and making the assumption that you have never seen this person). Then you have to think, is this person going to come back for it? Was it stolen and that person was just trying to unload it knowing that they could come back?

Then there is the moral issue. OK you go to the cops and they take your statement and impound the money. After that you will never see it again. But say the money becomes yours well then the IRS is going to take half of it.

Why wouldn't this person just give it to you sans the weapon? Personally I would just keep the money, hide it and leave to elsewhere for a while. What is the criminal go do?

If he points a gun at you, hes threatening your life. YES, its a crime. EVEN if hes giving you money.*

The only crime is stupidity on the part of the would-be thief.

If the guy threatens to shoot you if you don't take the money, it is the crime of assault.
