My question has to do with filing a joint return with W-2s from Virginia (with state income tax) and Texas (No state income tax). I moved and worked in Texas from June 2006 until December 2006 while my husband and children remained in Virginia. I normally use Turbo Tax to file our taxes. So would I just create a federal return listing all work and income from both states and then just file the Virginia State Income Tax with only income earned for within the state of Virginia for 2006? Right?

what is your home state? youre a legal resident of VA if your permanent home is in VA. im assuming you lived in TX temporarily for work purposes. if so, you are still considered a VA resident. you would need to report your TX earnings on your VA tax return. there is no TX income tax so you do not have to file there, but your TX earnings are taxable to your home state of VA.

you can read on page 3 of the instructions to determine your residency status. if you are determined to be a non-resident, you and your husband would file separate state VA tax returns, even though you filed the federal "joint".

That sounds right. Just be sure that you satisfy Texas's requirements for moving out of the state---that is, for establishing your legal residence in Virginia, and that Virginia's tax laws don't require you to pay tax on what you may have earned in Texas. You'll need to review the laws of both states carefully.
