i have a friend who is divorced from a man who retired from the militayr they were married for over 20 yrs so she gets part of his military retirement check as "community property" from the divorce. is she supposed to have to pay taxes on this? it is already taxed under her husband isn't it?

It is income to her, she is responsible for the taxes on the income

She pays tax on that. It's ordinary income to her.

It is NOT taxed to the husband first! The retiree's pension is reduced by the court-ordered amount for the ex-spouse. Each one pays tax on their share.
