Employers are supposed to ask for proof of legal right to work in the country when they employ you, whether you are an American citizen or foriegn worker, it's the law. You are then given a certain amount of time to produce the documents. During the course of the year, boss are also supposed to keep their records updated and have fresh declarations on file. A persons right to work can change thru a year eg Work permit dated from January, employed in August, the following year the card could be expired in January but the person is still working on the job. The employer would probably have forgotten the card will expire in January, therefore making him guilty of employing someone illegally.

Every employer is required by law to verify the legal status of new employees by requesting documentation that proves they are a citizen of or have permission to work here.

they are suppose to ask for your documentation BEFORE they hire you. They can't legally hire you unless you are here LEGALLY.
