if i am on my property, and a nieghbors dog (large rottwieler) is charging me, can i legally shot and kill the animal if i feel that my or my families safety are at risk? to clarify - not a barking or annoying dog ect.. i mean that the dog is comming at me ears back, jaws open ready to strike. please dont tell me to call animal control. im talking about a situation that requires an immediate response. would i be criminally liable? or would it be considered self defense? any help would be much apreciated.

p.s. animal lovers please dont give any silly answers about animal rights.

If your life or someone else's is danger of death or serious bodily harm you have the right to apply as much force as is necessary to stop the attack.

Its sounds as though you have all ready had a close encounter, if so this needs to be reported, and for God sake make a complaint and follow it through. We get a lot of dog calls but its rare that the complainant follows though with prosecution.

You are allowed to shoot a dog in Michigan if you face immediate danger, however there are laws about discharging a fire arm within city limits and laws about shooting a gun within 450 of a house. Usually if you are in danger these laws would be overlooked.

Great question...a hard one though. I would shoot and deal with the consequences later. Better to be alive then dead.
