Our neighbord (below us) at an apartment are loud every night.
My boyfriend and I live together and it is MAJORLY affecting our quality of life. We have complained to the management numerous times and they send letters (so they claim) and they claim to call them to remind them as well -- Whatever they are doing or not doing this guy YELLS and TALKS ALL NIGHT - NONSTOP -- I mean it sounds like he is giving a speech!
People have told me to gently ask them to be respectful, but if I open a conversation with this guy -- it will get bloody - frankly I am going insane -- I am ready to check myself in to an asylum.
Oh yeah - and the best part? there are no "noise" rules here --
Just a clause in the lease where it states - "Everyone is entitled to the peaceful enjoyment of their apartment"
Please help.

Put your complaint in writing, get it notarized, and mail it to the Manager certified with return receipt requested. If nothing is done by the third letter then withold your rent until you get your "peaceful enjoyment of your apartment".
Or pray that you downstairs neighbor moves.

First I need to say this. A lot of your complaints are "I saw this once" or "I never saw her do this". That's meaningless as you state you have a job. If you have a job you aren't watching her all the time. If you are watching her all the time, well this is obviously obsessing you! Now... on to the show... 1. If the lease only allows cats, then you need to tell the manager. She may be tying it outside though because this way she can tell the manager she doesn't have a dog in her apartment. I love dogs and would likely call animal control if my neighbor was keeping a dog constantly tied up in this situation. 2-5 would likely be considered heresay in a court of law as you do not live with the woman and have no actual evidence. So, if you are trying to build a case to leave the apartment, you need to forget about these. 6. You need to check on the mildew and mold policy of your state. Many states have laws on this as it has caused so many health problems. If there is mildew in her apartment, it likely is the fault of the complex. The issues you describe won't cause a mildew problem, poor sealing of wall joints are to blame for this. 7. Most apartments have a noise ordinance. If it is outside of the hours permitted, report her to the manager. Check the lease for this info. 8 The garbage issue should have also been addressed by the apt manager. I think I'd start calling them for now on. 9.The apt company should have fixed her blinds. she should have reported the issue to them. 10. You need to check your lease and see if it allows for storage of furniture and other items outside the front door of the apt or if they are only allowed in certain areas. What would I do? Start documenting. Stop posting your complaints on here and start writing to the management company. If you do not document the living conditions and tell them directly then there's nothing they can or will do. These people are not psychics and probably just trust whoever their managers are. If you document enough, you may be able to get out of your lease and move without providing the first and last months rent. You could use this as a bargaining chip. Tell them you are going to go to the health agency if you have to. Either way, start documenting, but leave anything out about what the interior of her apt is like. It just makes you look like trouble and like you are a bit nosy. You dont' want that.

Check the noise ordinance in your city. Most give a time when people have to be relatively quiet. Next time he's really loud call the police and tell them your neighbors are being loud.
Or if you don't want to go that far then write the neighbors a letter yourself and ask that they keep the noise at a respectful level at night and just sign it, your neighbors. Be nice and don't demand because that may just make them angry. If the management won't do anything then it looks like you'll have to do it yourself.

Yeah, I really hate to say this, but it's your apartment, not the neighbour, that's the problem. It sounds like your place hasn't been adequately sound proofed. I mean, loud music or TV full blast, that's a noise disturbance, but if this guy is just talking in his living room, what's he supposed to do? Not utter a peep all night? If the guy turns out to have a hearing problem, then what?

The fact that this guy lives below you makes it weirder. In most places, you could scream bloody murder and no one on the floor above you would even hear you.

Get the landlord to soundproof the place. Think of it as giving your neighbours their privacy.

Call your local tenant union to help you out. Do a search online with your city and type "tenant union". Call them up and talk about your problem. Since your landlord hasnt solve the problem, the tenant union can step in on your behalf. You should not have to live like this.

You may also call the police if the noise is extremely loud. If you do, get a copy of your complaint from the officers.

This situation sounds very much like mine. I to live above someone who is rather a lound talker all night. I really didnt want to confront him becasuse the few times we have talked he has been kinda out there. So I wrote a letter and put it next to my door and when I knew that he wasnt home, I put it up, saying the last few nights you've been kind of lound. So far its worked he hasnt been lound for the past couple of days, yeah I took the chicken way out but it wasnt worth getting in a fight for.

I used to have this problem....well it was the opposite. The lady underneath me complained about things like my bathroom fan being on.

Anyways...Definitely check with your local police department and ask about what time the noise ordinance kicks in. My city is 10 PM. After that call the police and tell them the guy above you is making noise. They'll come and hopefully go to your apartment first where they can hear the guy and then go upstairs and talk to him.

One NEVER can force another to respect them. Laws and rules may force them to do, or not do, certain things, but respect is earned, not dictated. That said:

Move. You have no choice. Your apartment rules are vague, and apparently the management hasn't gotten enough complaints from others to remove them. So, before you go crazy MOVE.

Say you can't afford to move??? Can you afford to pay medical bills, lose your job because you are insane? Where are you going to live after they check you out of the hospital for non-payment of fees? In a paper bag in the park?

There are two of you, hopefully two incomes, so MOVE.

There is no such word as "majorly". It sounds childish, and absurd when capitalized.

Ask the apartment management if you can move to another apartment. Explain that the noise of your neighbors is extremely rude and uncalled for. If that doesn't work,.... start banging on the wall on your apartment when they get loud. You could also try putting an anonymous letter on their door. Another suggestion, call the police if it's late at night. Tell the dispatch that it sounds like the guy is beating up on someone ..and it goes on all the time. They'll come out to investigate and scare the crap out of the tenants.

Call the police and report him as disturbing the peace. Most places have a time by which tenants have to stop the noise.
